Maybe closer to the dates, they will say that Dave is not on the tour due to “REALLY long Covid”. And then they will eventually cancel all of the dates to finish one new song.

Regardless of any legal loopholes the band MAY be jumping through, it’s a shitty, underhanded approach if they are continuing to avoid telling fans that Dave is not a part of things.

Have former band members sued over stuff like this if they are not involved? If Dave is not part of the tour, it’s clearly a move on the part of the band/management to mislead the public.
