Michael Jackson Doctor's Trial

Heh, first day and it's already compelling stuff. Interesting that the doctor's defense is that Jackson killed himself by upping his iv dosage when the doctor left the room. That voice message of a wasted Michael Jackson was pretty fucked up.

I don't buy it, it's his doctor's fault. He gave a very weak man medicine that could make an elephant go to sleep every night and pushed it too far

what ever happened to personal responsibility? he killed himself. michael hired the guy and i'm sure told him what to do. the doctor should obviously lose his license but he did not murder the guy.

you don't hire a doctor and tell him what to do, you hire him because you trust that he knows better than you do about medicine and how much and what to take

From what i understand, they found some of those IV drugs in Michael's stomach, meaning he was fucking drinking them. There is no way the doctor would have allowed that.

i think they'll find him guilty, although personally i'm not sure how i would find... they say he the doc received over 2 GALLONS of the stuff... that's crazy.

In my court of personal opinion where I am King, I can't see any way Murray won't be found guilty of some degree of manslaughter and unquestionably criminal negligence.

I agree Jackson bears some culpability in his own demise but it already seems pretty clear he couldn't have medicated himself into a stupor on a daily basis without a medical professional willing to ignore basic common sense. Not to mention it appears clear that Murray *knew* he fucked up and tried to dispose of evidence, he waited almost 90 minutes to call 911 and did not initially disclose he had dosed Jackson with Propofol.

he must be a fuckin idiot playing such a high stakes game. But I guess his reason for doing it was that if he hadn't gone along with giving him all that 'milk' Jackson would have found another dealer, I mean doctor

For negligence there are four important elements: duty, breach, causation and damages.

Here, what's important to remember, is his duty is greater than the average joe's because he is a medical doctor and MJ was a patient under his care. Regardless of who the patient was, how much he was paid, etc., he is held to the standard of care of the average medical doctor.

No fucking doctor in his right mind would have done a fraction of the stupid shit this guy did... :confused:

The defense is focusing on causation, arguing that he was not the direct or proximate cause of MJ's death. That issue is more problematic and involves medical issues over and above my knowledge. :noclue:

propofol is not orally active, so if he was drinking it, he was just wasting it.
The autopsy report http://www.thesmokinggun.com/documents/c… sttes that there were high blood levels of propofol, and that the stomach contained 70 grams of dark fluid (propofol is white, like milk). Propofol, lidocaine and flumazenil were detected in the IV tubing at the scene. 0.13 mg was detected in the gastric fluid, much less than was in the blood.

The jury seems to have agreed with you since they convicted him of involuntary manslaughter.

I have not followed the case closely, but it seems pretty obvious that the Dr. holds some culpability.
